About Abiza
This page sets out the terms that apply when you buy from us at abiza.co.uk. Abiza is owned and operated by Abiza (UK) Ltd, a family-run jewellery brand based in Chester, designing and making personalised and gemstone jewellery in our own workshop.
By placing an order with us or using this website, you agree to these terms. We update them from time to time — the version that applies to your order is the version live on this page at the moment you place that order.
In these terms, "we", "us" and "our" mean Abiza (UK) Ltd, trading as Abiza. "You" and "your" mean the person buying from us or using this website.
Our Contract with You
Placing an order is an offer to buy. A contract between us is formed when we send you an order confirmation email. Until that point, we may decline an order — for example if an item is no longer available, the price was listed in error, or we are unable to verify your details.
We always do our best to flag pricing errors and out-of-stock items before you check out. If something does slip through, we will contact you to put it right and refund any charge in full.
Pricing and Payment
All prices on the website are shown in GBP and include UK VAT where applicable. Delivery charges are shown at checkout before you confirm your order.
We accept the major payment methods listed at checkout. Payment is taken in full when you place the order. We do not store payment card details on our servers.
For international orders, customs duties or import taxes may apply on arrival in your country and are the recipient's responsibility.
Personalised, Custom and Engraved Items
This section is important and we want to be upfront about it.
Personalised items — including engraved jewellery, items with custom names, initials, dates, handwriting, paw prints, photo engravings, custom chain lengths and any other made-to-order specification — are made specifically for you. We begin production as soon as you confirm the personalisation details on your order.
Once production has started, personalised items cannot be cancelled, returned or refunded unless they arrive faulty, damaged or are not what you ordered. This is in line with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, regulation 28(1)(b), which excludes personalised and bespoke goods from the standard 14-day cancellation right.
Please double-check spellings, dates, capitalisation and any photos or images you supply before confirming your order. If you spot a mistake within one hour of ordering, contact us straight away and we'll do our best to amend it before production begins. After that point, we cannot remake personalised items free of charge unless the error is ours.
Delivery
We dispatch from our workshop in Chester, UK. Standard production time for personalised orders is shown on the relevant product page; non-personalised stock items are normally dispatched within 1–3 working days.
We ship using Royal Mail and equivalent international carriers. Estimated delivery times are shown at checkout. Once your parcel is with the carrier, the timing of delivery is the carrier's responsibility.
If your order has not arrived within the expected window, please contact us. We will work with the carrier to locate it. Royal Mail does not classify a UK item as "lost" until 10 working days after the expected delivery date, so we may need to wait that period before issuing a replacement or refund.
We are not responsible for delays caused by incorrect or incomplete addresses supplied at checkout.
Cancellation and Returns (Non-personalised Items)
For non-personalised items, you have a statutory right to cancel your order within 14 days of receiving it under the Consumer Contracts Regulations 2013. To exercise this right, please email us at info@abiza.co.uk within those 14 days, then return the item to us in unused, resaleable condition with all original packaging within a further 14 days.
Refunds are issued within 14 days of us receiving the item back. We refund the cost of the item and the cost of the cheapest standard delivery option we offered. Return postage is the customer's responsibility unless the item is faulty.
Items must be returned in their original, unworn condition. We may reduce the refund to reflect any loss of value if items show signs of wear beyond what was reasonably necessary to inspect them.
Faulty, Damaged or Lost Items
Under the Consumer Rights Act 2015, you are entitled to a refund, replacement or repair if your jewellery is faulty, not as described, or unfit for purpose.
If your order arrives faulty or damaged, please email us at info@abiza.co.uk within 30 days of receipt with clear photographs and your order number. We will arrange a free return and offer a full refund, replacement or repair as appropriate.
Beyond 30 days, we offer a 3-month warranty for genuine manufacturing faults. Email info@abiza.co.uk with photographs and your order number and we'll arrange a repair or replacement. This warranty is in addition to your statutory rights under the Consumer Rights Act 2015 and does not replace them.
This warranty does not cover damage caused by accident, misuse, normal wear and tear, contact with chemicals (including perfume, lotions and chlorine), or attempts to repair the item by anyone other than us.
Care of Your Jewellery
Each piece of Abiza jewellery is handmade and deserves to be looked after. Care guidance is included with every order and on our website.
In short: keep your jewellery dry, remove it before swimming, showering, exercising or sleeping, store it separately, and avoid contact with perfume, hand cream and household chemicals. Following this guidance keeps your jewellery looking its best and protects your warranty.
Use of Our Website
You may use our website to browse, place orders, read our content and contact us. You may not:
- copy, redistribute or commercially exploit any of our content, photography, designs or product imagery without written permission;
- use the website in any way that damages it or interferes with other users' access;
- use automated tools to scrape, harvest or extract data from the website;
- attempt to gain unauthorised access to our systems.
We reserve the right to refuse service or cancel orders where we suspect fraud, abuse or breach of these terms.
Intellectual Property and Brand Protection
The Abiza name and logo are registered trade marks of Abiza (UK) Ltd in the United Kingdom (UK Trade Marks Registry No. UK00003354523, Trade Marks Act 1994). The product designs, photography, written content and any artwork on this website are also our intellectual property and are protected under UK and international copyright and trade mark law.
You may not, without our express written permission:
- use, copy, alter or pass off the Abiza name, logo, brand or product imagery as your own;
- list our products or branded designs on third-party marketplaces;
- use any of our content, photography or designs to train artificial intelligence systems or commercial machine learning datasets.
If you would like to use our imagery for editorial, press, blog or affiliate purposes, please contact us at info@abiza.co.uk and we'll be happy to discuss it.
User Reviews and Submitted Content
If you submit a review, photograph, video or any other content to us — including reviews collected through our review platform partners — you grant us a non-exclusive, worldwide, royalty-free licence to use that content to promote our products on our website, social channels and marketing materials.
You must own the content you submit, and it must not be unlawful, defamatory, offensive, or infringe anyone else's rights. We may decline to publish or remove submitted content at our discretion.
Liability
We will always do everything reasonable to put things right when something goes wrong with your order, and your statutory rights as a UK consumer are not affected by these terms.
Our liability to you for any loss or damage arising in connection with these terms or your use of the website is limited to the amount you paid for the items concerned. We are not liable for indirect or consequential losses, loss of profit, loss of opportunity or any losses that were not reasonably foreseeable when you placed your order.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded under UK law.
Privacy and Cookies
Your privacy matters to us. The way we collect, use and protect your data is set out in our Privacy Policy. Information about how we use cookies is shown in the cookie banner on the website and in our Privacy Policy.
Changes to These Terms
We may update these terms from time to time, for example to reflect changes in the law or how we operate. The version that applies to your order is the version on this page at the moment you place your order. We will not change the terms of an order you have already placed without contacting you first.
Governing Law
These terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these terms will be dealt with by the courts of England and Wales, without prejudice to any statutory rights you have to bring proceedings in another UK jurisdiction.
